Terms of Service

1 · Service description

TAILORED. provides a credit-based virtual try-on platform that allows fashion merchants to generate photorealistic model images from product photography. The Service operates on a reserve-and-settle credit model: credits are reserved when a generation job is submitted and settled only when output images are accepted; unused reservations are released automatically.

2 · Accounts and access

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must be a business entity or act on behalf of a business entity to sign up; the Service is not intended for consumers. You agree to provide accurate, current, and complete registration information and to update it as necessary.

Each account is associated with a single organisation workspace. Multiple team members may be added to a workspace subject to plan limits. You are responsible for ensuring that all users within your workspace comply with these Terms.

3 · Acceptable use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to: (a) upload images you do not own or have rights to use; (b) generate images depicting real, identifiable persons without their explicit consent; (c) use the Service to produce content that is illegal, defamatory, obscene, or discriminatory; (d) attempt to reverse-engineer, scrape, or circumvent any security or rate-limiting mechanism; (e) resell or sublicense access to the Service without our prior written consent; or (f) use the Service in a way that could harm TAILORED. or its users.

All synthetic models generated by the Service are AI-generated and depict no real person. You must not represent generated images as photographs of real people.

4 · Payment and credits

Access to generation features requires an active subscription or sufficient credit balance. Subscriptions are billed in advance on a monthly basis. Credit top-ups are charged immediately on purchase. All fees are quoted and charged in euros (EUR) and are exclusive of applicable VAT.

Credits are reserved at job submission and settled only on merchant acceptance of output images. Reservations for failed or cancelled jobs are released automatically. Credits are non-refundable except where required by applicable law or as stated in our refund policy.

We reserve the right to adjust pricing with 30 days' notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

5 · Intellectual property and content ownership

You retain all intellectual property rights in the product images and other content you upload to the Service ("Merchant Content"). By uploading Merchant Content you grant us a limited, non-exclusive, worldwide licence to store, process, and use it solely to provide the Service to you.

Subject to full payment of the applicable credits, you own the generated output images produced from your Merchant Content and are granted a perpetual, royalty-free licence to use them for any lawful commercial purpose. We do not claim ownership of your generated images.

TAILORED. retains all rights in the platform, its underlying models, software, and technology. Nothing in these Terms transfers any intellectual property rights in the platform to you.

6 · Liability and disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by applicable law, TAILORED.'s total liability for any claim arising out of or related to these Terms or the Service is limited to the fees paid by you in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

We do not guarantee that generated images will meet any particular quality standard, achieve a specific commercial result, or be free from defects. Output quality depends on the input images and selected model parameters.

7 · Termination

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused subscription days unless required by law.

We may suspend or terminate your account immediately if you materially breach these Terms, fail to pay fees when due, or if we are required to do so by law. On termination, your right to use the Service ceases and we will delete your Merchant Content and generated images in accordance with our Privacy Notice.

8 · Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of München, Germany, unless mandatory consumer protection laws in your country of residence require otherwise.

9 · Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by e-mail and by a prominent notice in the application at least 14 days before they take effect. Continued use of the Service after that date constitutes your acceptance of the revised Terms.
